The EPA complied with the consent decree it agreed to with Growth Energy yesterday by signing its proposal for new renewable volume obligations (RVOs) — a package of proposed rules that is commonly referred to as the Set. Growth Energy had been in touch with EPA ahead of time about their plan for release and, at press time, is poised to quickly respond with its analysis. What's most important is that the June 14, 2023 deadline for the final rule (rather than just the EPA's proposal) remains intact. We will continue to work closely with EPA, members of the press, and other stakeholders to provide greater detail on what impact the proposal would have on the ethanol industry and make recommendations to strengthen the final RVOs.

Senator Deb Fischer (R-NE), Senator Amy Klobuchar (D-MN) and 13 of their colleagues introduced legislation this week that would allow for the sale of E15 year-round. The Consumer and Fuel Retailer Choice Act of 2022 amends the Clean Air Act to adjust its language regarding Reid vapor pressure (RVP) limitations to allow for fuels blended with 10% or more of ethanol to be treated the same as other liquid fuels. Growth Energy Urges Congress to Act Quickly to Avoid Rail Strike
After the House passed legislation this week that would impose a tentative agreement on American rail carriers and rail workers--thereby averting a strike--Growth Energy pushed the Senate to act with the same urgency and pass the bill. Throughout this process Growth Energy has had a seat at the table to ensure the concerns of its members were heard. As as member of the Agriculture Transportation Working Group we've issued several letters on rail service issues and other topics, signed on to two letters written by the U.S. Chamber of Commerce, and testified in April before the Surface Transporation Board regarding rail service and its impact on our industry. As negotiations seem likely to head down to the wire, we will continue to keep you informed and continue to ensure ethanol producers' voices are heard by decision-makers in Washington.

Growth Energy Urges USDA to Prioritize Bioethanol in IRA Implementation
This week Growth Energy submitted comments to the USDA that made recommendations to the agency's Rural Business-Cooperative Service on how to make the most of certain provisions in the Inflation Reduction Act (IRA). Specifically, Growth Energy recommended that USDA administer the aforementioned $500 million in a way that maximizes the use of higher ethanol-blended fuels like E15. Treasury Hosting Briefing Today at 4pm ET for Stakeholders on IRA Labor Guidance
This week the U.S. Department of the Treasury released its first guidance on the labor provisions of the Inflation Reduction Act (IRA) that are pertinent to enhanced clean energy and climate tax incentives. To gather feedback on the guidance the agency is hosting a virtual briefing regarding today, December 1st at 4:00 pm ET.
